The fact that the data is retained without the users of electronic #communications services being informed of the fact is likely to cause the persons concerned to feel that their #private lives are the subject of constant #surveillance. Consequently, only the objective of fighting serious crime is capable of justifying such interference.
“Such national legislation therefore exceeds the limits of what is strictly necessary and cannot be considered to be justified within a democratic society (sic), as required by the directive, read in the light of the charter.”

The result, though significant, could eventually prove academic once the #UK has withdrawn from the #EU and the #ECJ no longer has judicial authority over the UK.

Meanwhile UK parliament this week has quietly, without substantive opposition or media interest, passed the most pervasive and invasive mass surveillance legislation in history. The Investigatory Powers Bill is 304 pages of complex permissions for the UK intelligence and security services, police and other public bodies to engage in bulk
  • interception
  • acquisition
  • retention
of communications data of the entire population and all other communications traversing the UK, access to bulk personal datasets held by other individuals, communities, groups, public services, civil society or economic actors and bulk equipment interference (aka hacking).

The depth and reach of the legislation is quite staggering. That it has been slipped through in the wake of Mr Trump's election really should not escape notice..... .... ....

It is the usual story: we should disallow companies from using perfect end to end #encryption and force them to insert #backdoors against #terrorists. Not that it would help - that's been discussed extensively already but in short: * If you have nothing to hide, you'll use a backdoored app and you're vulnerable to foreign (and your own) #governments, terrorists (!), #criminals and others who can abuse your #data in more ways than you can imagine. * If you have something to hide, you can use 1000 different tools to do so and there is nothing government can do about that so you won't use a backdoored app. * And note that government has failed to even use fully unencrypted information to stop terrorist #attacks so perhaps we should first see if they can actually get their act together there.
